SMILES PROGRAM REGULATIONS

The Smiles Program, maintained by Gol Linhas Aéreas S.A. ("Gol") successor by incorporation of Smiles Fidelidade S.A. (CNPJ 05.730.375/0001-20), is its own coalition program for customer loyalty, consisting of a platform for accrual and redemption of Miles, through a wide network of Air, Commercial and Financial Partners, in accordance with the terms and conditions of these Regulations and which seeks, primarily, to encourage the Participant, as defined below, to use Gol's air transport services, as described in these Regulations.

1. DEFINITIONS AND CONCEPTS 1.1. In these Regulations, the following words, and expressions, when written in capital letters, have the meaning indicated below: "Smiles Mile Generator Act": is the action that allows you to earn Smiles Miles by the Smiles Program Participant; "Air Ticket": is the award air ticket, redemption able and issued with Smiles Miles; "Smiles Category Card": is the virtual identification card, available to all Smiles Participant for printing on www.smiles.com.br, in a logged-in environment and using Smiles Access Data;
"Gol Smiles Credit Card": means credit cards issued under the payment arrangement established by some Flag and issued by a responsible issuing Financial Institution, and which will share the "Smiles", "Gol" and issuing Bank marks on a "co-branded" card. Such cards have all the functionalities of a conventional credit card, according to market practices, including financial products at the discretion of the issuing Bank.
"Smiles Category": are the existing Smiles Category Card ratings in the Smiles Program: Smiles, Silver, Gold or Diamond, or others that may be created;
"Smiles Club": is a club of exclusive advantages and benefits, administered by Gol, where the Smiles Program Participant may join, observing its terms and conditions, to enjoy such benefits, regardless of their Card Category in the Smiles Program, and obtain exceptional promotions.
"Smiles Account": is the sole account of the Smiles Program Participant, where accruals and redemptions of Smiles Miles are recorded, the expiration period of The Smiles Miles, the Participant's registration data, and others;
"Smiles Access Data": is the set formed by The Smiles Number and The Smiles Password, which identifies the Participant and allows access and movement of the Smiles Account;
"Virtual Store": a website on the worldwide computer network owned by Gol, where Smiles Miles are allowed to be redeemed for the purchase of Smiles Awards, accessed through the Smiles Website;
"Qualifying Mile": is the Smiles Program unit, which entitles the Participant to change the Smiles Category in the Smiles Program;
"Smiles Mile": is the Smiles Program unit that represents prepayment for Smiles Awards;
"Smiles Number": is the identification number of the Participant in the Smiles Program;
"Air Partners": are Gol's partner air transport companies that offer air transport products or services in the Smiles Program, being solely responsible for the products and services redeemed on the Smiles website before Gol and the Participant;
"Commercial Partners": are Gol's partner companies that may offer their products and services in the Online Store, as well as grant Smiles Miles to Participants and/or offer products and services for "on-the-spot" exchange, being solely responsible for the products and services redeemed on the Smiles Site before Gol to the Participant;
"Financial Partners" means financial institutions that award Smiles miles to their credit card users and other financial products, according to specific rules established by their partner;
"Partners" means, when referred to, jointly, the Air Partners, Business Partners and Financial Partners;
"Participant": is the individual registered in the Smiles Program;
"Smiles Award": is the Air Ticket purchased by the Participant, and may also, at GOL's discretion and upon request of the Participants, represent any product, service, advantage and/or benefit of Gol or any of its Partners, redeemed with Smiles Miles by the Participant;
"Accrual Processing": Effective accumulation of Miles in the Participant's Smiles Account;
"Smiles Program": is the coalition program maintained by Gol, consisting of a virtual platform for the accumulation and redemption of Smiles Miles, to obtain, by the Participants, prizes, advantages or benefits offered by Gol itself or its Partners and which seeks to encourage, mainly, the use of Gol's air transport services by the Participant;
"Partner Program": is the relationship or business incentive program maintained by the Airline Partner, Commercial partner or Financial Partner itself;
"Regulation": is this document, which establishes the rules, terms and conditions of operation of the Smiles Program;
"Requalification": is the act performed on March 31 of each calendar year, when it is verified whether the Entrant has reached the amount of Qualifying Miles or Qualifying Segments required for their stay in the Smiles Category that is located or should be reclassified into the Immediately Lower Smiles Category.
"Smiles password: is the personal and non-transferable password for access to the Smiles Account;
"Gol": is Gol Linhas Aéreas S.A., administrator of the Smiles Program, successor by incorporation of SMILES FIDELIDADE S.A. (CNPJ/MF 05.730.375/0001-20), a corporation regularly incorporated in the country, registered with CNPJ/mf under no. 07.575.651/0037-60,, with headquarters in Alameda Rio Negro, no. 585, Padauiri Building, Block B, 2nd floor, sets 21 and 22 – Part A, Alphaville, ZIP Code 06454-000, in The City of Barueri, State of São Paulo;
"Smiles Website": is the electronic address www.smiles.com.br;
"Leg: Will be considered 01(one) Route each flight made with Gol or any Air Partner (origin and destination), regardless of stopovers or connections that exist on the route.
"Qualifying Excerpt(is)": It has the meaning defined in clause 10.1.1. and 10.1.2. below.

2. SMILES PROGRAM AFFILIATION

2.1. Only individuals, over 18 years of age or minors assisted by their respective legal guardians may register in the Smiles Program, with active registration in the Register of Individuals, with the Ministry of Finance or valid identification document in the country of their residence.

2.1.1. If the Participant is relatively or absolutely incapable, under Brazilian civil law, declares that his registration for use of the Smiles Program and consequent acceptance of these Regulations, was accompanied by his legal guardian, as an assistant or representative, as the case may be, who must have active Smiles account for validation and linking of the registers, that thus, they are responsible for their actions in the use of the Smiles Program, in the case of any unlawful conduct, in the form of the civil legislation in force.

2.2. Before enrolling in the Smiles Program, the interested party must read in full these Regulations and its Annexes, including any changes, as well as the privacy policy of the website. By requesting registration in the Smiles Program, the interested party confirms its spontaneous participation in the Program, as well as expresses its agreement with all the rules, terms and conditions provided for in these Regulations and in the privacy policy. In case of disagreement, it will not be possible to register the interested party in the Smiles Program.

2.3. The registration in the Smiles Program must be made by the interested party on the Smiles Website or other service channels that may be made available by Gol. For registration will be requested personal data of the interested party, including, but not limited to, the full name, nationality, gender, date of birth, id, registration number in the Register of Individuals of the Ministry of Economy, document admittedly valid for residents and domiciled abroad, address for communication, home telephone, mobile phone and e-mail address, if you do not allow the same email address to be used in more than one Smiles Account.

2.3.1. Gol requests such personal data when the Participant is entered into the Smiles Program for the reasons set out in the privacy policy that must be read and accepted by the Participants.

2.3.2. It is the Participant's responsibility to keep all registration information complete and duly updated, under penalty of not being able to enjoy all the prizes, advantages and benefits offered by Gol and its Partners on the Smiles Program platform. Gol is not responsible, in any event, for any damages or losses arising from incorrect information presented by the Participant.

2.4. When applying for their registration in the Smiles Program, the interested party declares that the information provided is faithful and true, for all purposes of law, under the penalties of the law, especially those provided for in Brazilian Federal Law No. 7,115 of August 29, 1983, and Article 299 of the Penal Code (Ideological Falsehood).

2.4.1. If the information provided to the Smiles Program is proven to be false, the person concerned will be subject to the civil, administrative, and criminal sanctions provided for in applicable law, and the Participant may be excluded from the Smiles Program.

3. ANALYSIS OF THE APPLICATION FOR REGISTRATION IN THE SMILES PROGRAM

3.1. The analysis of the application for registration in the Smiles Program will be carried out by Gol, according to its own criteria of analysis, which will be responsible for deferring or rejecting the request.

3.2. There are reasons for the rejection of the application for registration in the Smiles Program, among others:

(a) the presentation of false, irregular or insufficient information or documentation by the person concerned;

b) the identification of any evidence or evidence of bias, fraud, or irregularity in the register; and

c) the attempt to re-enter the Participant Smiles Program that has been excluded from it, in the cases provided for in these Regulations.

3.3. For the analysis of the application for registration, Gol may request the presentation of documents proving the identity of the interested party, as well as the other information provided by him for the security purposes of the interested party itself.

4. SMILES ACCOUNT

4.1. Upon approval of the application, a Smiles Account will be created for the Participant, in which Smiles Miles, accruals and redemptions, the expiration period of the Miles and the Participant's registration data, among others, are recorded.

4.1.1. All Participants will be provided with a virtual IDENTIFICATION card, called a Smiles Category Card, available for printing on the Smiles Site, in the Participant's exclusive logged-in area.

4.1.2. After having your registration in the Smiles Program approved, the Participant will receive, at the e-mail address registered by him, his Smiles Number.

4.2. The Participant may have only a single active Smiles Account. If more than one Smiles Account is identified for the same Entrant, Gol reserves the right to cancel and delete the duplicate account in the registration, keeping the Smiles Account active with the largest Smiles Miles balance. Smiles in the cancelled account will be the subject of internal analysis by Gol and, if the cancellation is not due to suspected fraud or registration containing untrue information, Smiles Miles may be transferred to the account that remains active, with the same original validity period.

5. CANCELLATION, SUSPENSION AND EXCLUSION OF THE SMILES PROGRAM

5.1 THIS AGREEMENT MAY BE REPLACED BY THE PARTIES AT ANY TIME, UPON PRIOR NOTICE, IN WRITING.

5.2. It is the Participant's right, at any time and without prior justification, to request the cancellation of their participation in the Smiles Program, by express communication to the Smiles Service Center or directly on the Smiles Site.

5.2.1. The cancellation request may only be made by the Participant himself, or his/her legal guardian, if applicable, according to item 2.1., and Gol is provided to request the presentation of documents proving the identity of the applicant.

5.2.2. The CANCELLATION REQUEST WILL RESULT IN THE CANCELLATION OF THE SMILES ACCOUNT AND The SMILES MILES REGISTERED THEREIN. AIR TICKETS ALREADY ISSUED AND NOT YET USED WILL REMAIN VALID AND THE PARTICIPANT MAY CONSULT THE FLIGHT DATA AND OTHER INFORMATION DIRECTLY WITH GOL FOR FLIGHTS OPERATED BY GOL OR WITH THE AIRLINE PARTNER RESPONSIBLE FOR THE OTHER FLIGHTS OR, FURTHERMORE, AT the SMILES SERVICE CENTER.

5.2.2.1. IN CASES OF BOOKING GOL TICKETS OR USE OF SMILES PRODUCTS FOR ISSUING TICKETS THAT HAVE NOT YET BEEN (RAM) PAID FOR BY THE PARTICIPANT (E.G. EASY TRAVEL PRODUCT), THESE WILL BE AUTOMATICALLY CANCELLED BY GOL.

5.2.3. THE PARTICIPANT WHO REQUESTS THE CANCELLATION OF HIS PARTICIPATION IN THE SMILES PROGRAM SHALL NOT BE ENTITLED TO ANY KIND OF COMPENSATION OR REPARATION FOR THE CANCELLATION OF SMILES MILES.

5.2.4. If the Participant requests the cancellation of the Smiles Program, Gol will proceed efficiently and cordially, without prejudice to the collection of any existing obligations. Gol will arrange the cancellation requested by the Participant with immediate effect, without objecting to any difficulty or obstacle to the cancellation.

5.3. WITHOUT PREJUDICE TO THE CIVIL, ADMINISTRATIVE AND CRIMINAL PENALTIES, GOL MAY EXCLUDE OR SUSPEND FROM THE SMILES PROGRAM THE PARTICIPANT WHO:

a) negotiate, in any form, your Smiles Miles with third parties, outside the rules set forth in these Regulations, including, but not limited to, cases of irregular purchase and sale of Air Tickets or products and services made available in the Online Store;

b) employ any type of fraud, artifice or ruse in the use, accumulation or redemption of Miles or Smiles Awards;

c) to engage in any illegal, irregular or contrary conduct to the provisions of these Regulations or in the regulations of the Partner Programs, as well as conduct contrary to morals and good customs;

d) when the Participant makes irregular, inappropriate or suspicious use of his Smiles Account or, in any way, contributes to the irregular use of the Program, or causes harm to Gol or its Air, Commercial Partners and their Financial Partners;

e) when the Participant in any event contributes to the occurrence of fraud to the Smiles Program, including, but not limited to, providing false or inaccurate information for enrollment in the Smiles Program; the provision of false or inaccurate information for the conduct of a transaction with Smiles Miles; or fraudulent or irregular communication of the loss, theft or theft of the Category Smiles Card or system access password.

f) when the Participant, after knowing the fact, ceases to immediately communicate to Gol about the occurrence or suspicion of loss, theft, theft or violation of his password to access the system, including when he no longer requests the blocking of the Smiles Account or the replacement of the Password;

g) when the Participant provides his/her Smiles Account Access Number and/or Password to third parties.

5.3.1. IN CASE OF SUSPICION, INDICATION OR PROOF OF FRAUDULENT OR IRREGULAR USE OF THE SMILES ACCOUNT, THE SMILES PROGRAM OR THE SMILES ACCOUNT ACCESS PASSWORD, GOL MAY TEMPORARILY SUSPEND THE USE OF THE SMILES ACCOUNT, AS WELL AS ASK THE PROGRAM PARTICIPANT TO PROVIDE INFORMATION AND CLARIFICATIONS NECESSARY TO ELUCIDATE THE FACTS.

5.3.2. The Participant who is suspended or excluded from the Smiles Program, by the practice of the conduct provided for in item 5.3, the rules provided for in items 5.2.2., 5.2.2.1 and 5.2.3 shall apply.

5.4. The practice of the conduct provided for in item 5.3 may also entail, at Gol's sole discretion:

A) The REVERSAL IN THE SMILES ACCOUNT OF MILES SMILES OBTAINED IRREGULARLY OR BY FRAUD, ARTIFICE OR RUSE;

B) THE CANCELLATION OF THE SMILES AWARDS OF THE PARTICIPANT WHO COMMITTED OR CORROBORATED WITH THE IRREGULARITY, FRAUD, ARTIFICE OR RUSE; And

C) THE SUSPENSION OF THE ACCESS OF THE OFFENDING PARTICIPANT TO THE SMILES PROGRAM, INDEFINITELY.

5.5. THE SMILES ACCOUNT WHOSE BALANCE IS EQUAL TO ZERO AND NOT MOVED FOR A PERIOD OF MORE THAN 12 (TWELVE) MONTHS, MAY BE CANCELLED BY GOL, WHICH WILL COMMUNICATE, PREFERABLY BY E-MAIL, THE PARTICIPANT REGARDING CANCELLATION, WITH 30 (THIRTY) DAYS IN ADVANCE.

5.6. IN THE EVENT OF DEATH OF THE PARTICIPANT OF THE SMILES PROGRAM, THE SMILES ACCOUNT OF OWNERSHIP OF THE DECEASED WILL BE IMMEDIATELY TERMINATED, AND THE SMILES MILES CANCELLED. REDEMPTIONS MADE ON THE DECEASED'S SMILES ACCOUNT WILL REMAIN VALID. THE MISUSE OF MILES SMILES OF THE DECEASED PARTICIPANT WILL SUBJECT THE INFRINGER TO THE EXCLUSION OF THE SMILES PROGRAM, IF REGISTERED, IN ADDITION TO THE CIVIL, ADMINISTRATIVE AND CRIMINAL PENALTIES PROVIDED FOR IN THE LEGISLATION IN FORCE.

6. USE AND PRIVACY POLICY

6.1. Gol is committed to respecting the privacy and confidentiality of personal, registration, financial and other data accessed or shared by the Smiles Program Participant, including through the Smiles Site, pursuant to these Regulations.

6.1.1. By requesting registration in the Smiles Program, the Participant expressly agrees that the information referred to in item 6.1 may be stored and used by Gol and its Air, Commercial and Financial Partners, with a view to offering products or services, developing promotional campaigns, analyzing, and processing data and statistics, detecting and avoiding fraud and other illegal activities, as part of investigations.

6.1.2. The authorization contained in item 6.1.1. reaches subsidiaries, affiliates, representative offices and third parties selected by Gol and its Air, Commercial and Financial Partners, in Brazil or abroad.

6.1.3. The information referred to in item 6.1 may be accessed, retained, or shared in response to a request from a judicial, administrative or regulatory body, or for use in legal or administrative proceedings, in Brazil or abroad.

6.2. The Smiles Number and Password are for the personal and exclusive use of the Participant, which must keep them safe, confidential and confidential, not revealing them, disclosing or providing them to third parties.

6.3. Gol expressly recommends that the Participant does not access his Smiles Account through computers, mobile phones, tablets and other electronic equipment in unsafe, suspicious, open, shared or in any way that may pose risks to the transaction or facilitate the occurrence of fraud.

6.3.1. Gol also expressly recommends that the Participant adopt security measures on computers, mobile phones, tablets and other electronic equipment used to access the Smiles Program, such as, but not limited to, the installation and use of antivirus, anti-spyware and adware programs.

6.4. Gol shall not be liable for the misuse of the Participant's Smiles Number and Password, including, but not limited to, the possibility of loss, theft or loss by any means or form. The misuse of the access data shall be the sole responsibility of the Participant, including liability for damages resulting from misuse by third parties, dispensing Gol of any liability for such acts.

6.5. The Participant OF THE SMILES PROGRAM ALSO UNDERTAKES TO:

A) DO NOT REQUEST THE NUMBER AND/OR PASSWORD SMILES OF ANOTHER PARTICIPANT AND NOR ACCESS THE SMILES ACCOUNT BELONGING TO ANOTHER PARTICIPANT;

B) DO NOT USE THE SMILES PROGRAM FOR THE PRACTICE OF ANY ILLEGAL, IRREGULAR OR FRAUDULENT ACT;

C) DO NOT SHARE YOUR SMILES ACCESS DATA, INCLUDING THE SMILES NUMBER AND/OR PASSWORD SMILES, WITH ANY OTHER PERSON, EVEN IF YOU PARTICIPANT OF THE SMILES PROGRAM, AND NOT LET ANYONE ELSE ACCESS YOUR SMILES ACCOUNT;

D) DO NOT CREATE A SMILES ACCOUNT FOR ANYONE OTHER THAN OWN, EXCEPT WHEN AUTHORIZED BY SMILES;

E) DO NOT CREATE MORE THAN ONE SMILES ACCOUNT FOR YOURSELF;

F) IN THE CHANCES OF SUSPENSION OR EXCLUSION OF THE SMILES PROGRAM, DO NOT REQUEST RE-REGISTRATION WITHOUT EXPRESS PERMISSION OF SMILES;

G) DO NOT PRACTICE ANY ACT THAT MAY COMPROMISE THE SECURITY OF YOUR SMILES ACCOUNT;

H) DO NOT TRANSFER THE ADMINISTRATION OR MANAGEMENT OF YOUR SMILES ACCOUNT TO THIRD PARTIES; and

I) IN CASE OF ACCESS TO THE SMILES PROGRAM BY MOBILE PHONE DEVICE, TABLET OR EQUIVALENT, PAY FOR THE COSTS, FEES AND TAXES CHARGED BY YOUR TELEPHONE AND INTERNET OPERATOR.

6.6. Gol will send e-mail messages to Smiles Program Participants about the movements made in the Smiles Account. Messages, news and promotional communications from Gol and its Air, Commercial and Financial Partners will be sent to Participants and, if the Participant does not wish to receive them, may ask Gol to stop forwarding them.

6.6.1. Gol and its Air, Commercial and Financial Partners never send e-mail messages to Smiles Program Participants requesting the provision of Smiles Access Data or any other sensitive or confidential data or information. If the Participant has any kind of doubt about the authenticity of the messages received in his e-mail, he/she should immediately contact the Smiles Call Center.

7. Miles SMILES

7.1. Smiles Mile is the unit of measure used by Gol to account for the accumulation and redemption of rewards, advantages and benefits granted by partners on the Smiles Program platform.

7.2. SMILES MILES ARE OF PERSONAL AND NON-TRANSFERABLE USE, BEING VEDA YOUR TRANSFER TO THIRD PARTIES, TO ANY TITLE, SUCH AS, BUT NOT LIMITED, TO THE CHANCES OF SALE, PURCHASE, DONATION, EXCHANGE, ASSIGNMENT, SUCCESSION, INHERITANCE OR ANY OTHER FORM OF FREE OR ONEROUS TRANSFER. SMILES MILES CANNOT BE CONVERTED INTO CASH, IN WHOLE OR IN PART, UNDER ANY CIRCUMSTANCES.

7.2.1. The sealing contained in item 7.2 of these Regulations may be punctually exceptional, in the case of products or services developed by Gol and its Air, Commercial Partners and their Financial Partners, when the specific rules of such products or services will then be observed.

7.3. Smiles Miles Generating Acts (Accrual):

a) the performance of domestic or international flights with Gol and/or the Air Partners, provided that Gol and/or air partners flights are eligible for the accumulation of Smiles Miles and in accordance with the provisions of item 7.8;

b) the acquisition of Smiles Program Commercial Partner Products or Services, provided that The Commercial Partner Products and Services are eligible to award Smiles Miles for Accrual; and

c) the transfer of Financial or Commercial Partners points for conversion into Smiles Miles in the Smiles Program.

7.3.1. The rules for accrual Smiles Miles on Gol flights, as well as the rules for accrual of Smiles Miles on Airline Partner flights are defined by Gol, for their flights and for each Airline Partner, for their respective flights, and are available for consultation on the Smiles Website.

7.3.2. With respect to the Smiles Miles Generating Act provided for in paragraph "b" of item 7.3 (Business Partners):

a) The Commercial Partners of the Smiles Program will pre-define the number of Smiles Miles assigned to each product or service purchased by the Participant, and the Program Participant must be informed of such Accrual rules prior to the purchase of the product or service from the Business Partners; and

b) The accrual of Smiles Miles will only be made when the purchase of the product or service is complete, paid and regularly made with the Business Partner.

7.4. To earn Smiles Miles, the Entrant must be regularly enrolled in the Smiles Program and provide the number of their Smiles Or CPF Account, as applicable, when performing any Smiles Mileage Generating Act with Gol or with partners.

7.5. Each of the Smiles Mile Generating Acts has a specific term for credit in the Participant's Smiles Account. Gol has up to 60 (sixty) days of time, from the Participant's request, for flights operated by Gol itself and, for other cases, from the request of each Airline Partner, Commercial or Financial Partner, to credit the Smiles Miles in the Smiles Account. The Participant must have the documents proving the operation to guarantee his/her right to the accumulation of Smiles Miles.

7.6. The Participant shall pay close to the deadline for applying for the credit of The Smiles Miles in his Smiles Account, observing the rules stipulated by Gol, limited to the products promoted by it and by each Partner, limited to the respective products promoted by them. Eventually, the application for the credit of The Smiles Miles may only be made at the time of the practice of the Smiles Miles Generating Act, under penalty of decay of the right.

7.7. Smiles Miles may only be credited once to the Smiles Account of the Participant who has performed the Smiles Miles Generating Act. If the Miles Generating Act enables the accumulation of benefits in more than one loyalty program, the Participant must choose which loyalty program he/she wishes to score, renouncing the accrual on the other program(s). Miles accrued in duplicate programs are subject to chargeback by Gol and/or other loyalty program(s).

7.7.1. The Accrual of Smiles Miles arising from domestic or international flights with The Air Partners will be recorded in the Smiles Account of the passenger who actually flies, through their Smiles Number or CPF, regardless of whether the third party has borne the cost of acquiring the air ticket.

7.8. According to policies established by Gol and the Air Partners, there are no Smiles Miles Generating Acts, among others that may be stipulated by them:

(a) the completion of a charter, domestic or international flight;

b) the performance of domestic or international flight with the use of air ticket granted by courtesy or in awards and sweepstakes of Gol and Air Partners, Commercial s or Financial Partners, including Air Ticket redeemed with Smiles Miles;

c) the performance of domestic or international flight with the use of promotional ticket subject to specific fare conditions;

d) the performance of domestic or international flight with the use of non-regular fare Air Ticket, such as group and negotiated fares; and

e) payments of any taxes and airport or other fees, fines and penalties imposed by Gol and the Air Partner.

7.9. Gol may charge back the Smiles Miles credited to the Participant's Smiles Account, as well as cancel any transactions made by the Participant, if:

a) the Smiles Miles Generating Act is not properly effected, including payment, if applicable;

b) it is identified that Smiles Miles were acquired unlawfully, irregularly, or fraudulently; and

c) it is identified that the redemption of the Smiles Award occurred in an unlawful, irregular, or fraudulent manner.

7.9.1. In the cases provided for in item 7.9, Air Tickets may be cancelled by Gol or its Air Partners, as well as the other Smiles Awards may be suspended. If the delivery has already occurred, the Participant must return them intact or refund the Business Partner.

8. VALIDITY OF SMILES MILES

8.1. The validity of accumulated Smiles Miles will vary according to the category of the Participant's Smiles Category Card, as follows:

a) 36 (thirty-six) months, for the Smiles and Silver categories;

b) 48 (forty-eight) months, for the GOLD category;

c) 120 (one hundred and twenty) months, for the DIAMOND category.

8.1.1. Validity shall be computed from the date and time of crediting the Smiles Miles to the Smiles Account based on the category in force prior to such accrual. Debits in Smiles Miles will be made by the closest due dates to the most distant ones. The Participant must monitor the validity and expiration of their Smiles Miles, through information available in their Smiles Account, on the Smiles Site.

8.2. Smiles Miles may be valid other than that provided for in item 8.1. in the case of:

a) promotions;

b) bonuses; and

c) adhering to a particular Gol product and/or service (example: Clube Smiles).

8.2.1. Information on the differentiated validity of Smiles Miles will be disclosed on the Smiles Website; pursuant to and conditions of Gol's promotions, bonuses and/or products or services, as well as in the other disclosure channels provided by Gol and shall observe, as appropriate, the provisions of Clause 9 of these Regulations.

9. GOL PRODUCTS

9.1. Gol may develop specific products to enable Smiles Program Participants to have greater chances of accrual or redemption of Smiles Miles with Partners.

9.1.1. The products mentioned in clause 9.1 each have their own Rules or Terms and Conditions of Use, prepared in line with these Regulations, and made available for consultation of interested parties on the Smiles Site.

9.1.2. The products mentioned in clause 9.1 may be seasonal, periodic, or permanent, and it is certain that they may be extinguished by Gol at any time without notice.

10. SMILES CATEGORY CARD

10.1. The Smiles Program offers 04 (four) types of Smiles Categories to Smiles Program Participants depending on the Qualifying Miles and/or Qualifying Earned Segments, which vary as described in item 10.3., under the conditions and proportions presented below.

10.1.1. The following hypotheses of Excerpt will be considered within the calendar year (January to December) for the accounting of 01(one) Qualifying Excerpt:

a) Segment operated by Gol purchased on Gol's other channels (except in Smiles Program channels) and/or redeemed with Smiles Miles on Smiles Program channels;

b) Segment operated by Gol or the Air Partners whose fare earns Smiles Miles and which the Participant has requested the accumulation in the Smiles Program. To be aware of the fares that earn Smiles Miles, the Participant must previously consult with Gol or the Air Partners in the available channels;

c) Segment operated by the Air Partners issued with Smiles miles and that have the participation of a stretch operated by Gol.

10.1.2. The following hypotheses shall be considered within the calendar year (January to December) for the accounting of 01(one) Qualifying Mile:

a) For every 10 (ten) Smiles Miles earned with Smiles Credit Cards, or through the Smiles Miles of the active Smiles Club plan, entitle you to 01 (one) Qualifying Miles, except miles distributed as bonuses, i.e., issued not as a result of the effective practice of a Miles Generating Act;

b) For every 01 (one) Mile Smiles derived from Gol or Air Partners entitles to 01 (one) Qualifying Mile, except miles distributed as bonuses, that is, not as a result of the effective practice of a Miles Generating Act.

10.1.2.1. Other accumulated Smiles Miles do not generate Qualifying Miles.

10.1.3. Gol and The Air Partners may change the exchange ratio of Smiles Miles into Qualifying Miles, depending on the commercial conditions negotiated between the Parties. They may also establish, through promotional campaigns, changes in the proportion of exchange for a specified period. Both hypotheses set out here will always be widely disseminated to participants.

10.1.4. Qualifying Miles will be calculated for each accrual transaction, applying the proportion provided for in item 10.3 and rounding up or down the result obtained.

10.2. Under these Regulations, the Participant must provide his/her valid Smiles or CPF number to earn Smiles Miles and count Qualifying Miles and Qualifying Miles.

10.2.1. If the interested party is not registered in the Smiles Program when requesting the accrual from Gol or with a Partner, the latter will be momentarily unable to earn Smiles Miles and count Qualifying Miles and Qualifying Miles. In addition to the accumulation, the interested party must observe the rules and deadlines of Gol and each Partner.

10.3. Qualifying Miles and Qualifying Miles flown for change of Smiles Category will be deemed to be deemed to be in the following compliance:

a) Category Smiles: It is the initial category of the program, intended for the Participant who has accumulated between 0 (zero) and 9,999 (nine thousand, nine hundred and ninety-nine) Qualifying Miles and/or flown from 0 (zero) to 09 (nine) Qualifying Segments with Gol or with the Air Partners during the calendar year (January to December), applying the rules provided for in these Regulations;

b) Silver Category: intended for the Participant who has accumulated between 10,000 (ten thousand) and 17,999 (seventeen thousand, nine hundred and ninety-nine) Qualifying Miles and/or flew from 10 (ten) to 17 (seventeen) Qualifying Segments with Gol or with the Air Partners during the calendar year (January to December), applying the rules provided for in these Regulations. If the Entrant exceeds the number of Qualifying Miles and/or Qualifying Segments flown in the amount described above, qualifying miles and/or excess Qualifying Segments will be considered for Requalification or category upgrade in the subsequent calendar year;

c) Gold Category: intended for the Participant who has accumulated between 18,000 (eighteen thousand) and 29,999 (twenty-nine thousand, nine hundred and ninety-nine) Qualifying Miles and/or flew 18 (eighteen) to 29 (twenty-nine) Qualifying Segments with Gol or the Air Partners during the calendar year (January to December), applying to rules provided for in these Regulations. If the Entrant exceeds the number of Qualifying Miles and/or Qualifying Segments flown in the amount described above, qualifying miles and/or excess Qualifying Segments will be considered for Requalification or category upgrade in the subsequent calendar year; and

d) Diamond Category: intended for the Participant who has accumulated from 30,000 (thirty thousand) Qualifying Miles and/or flown from 30 (thirty) Qualifying Segments with Gol or the Air Partners during the calendar year (January to December), applying the rules provided for in this Regulation. If the Entrant exceeds the number of Qualifying Miles and/or Qualifying Segments flown in the amount described above, qualifying miles and/or qualifying earned over runs will be considered for Requalification in the subsequent calendar year.

10.3.1. If the Entrant reaches the number of Qualifying Miles and Qualifying Segments concurrently, the rules for maintaining, upgrading, upgrading and maintaining Qualifying Miles and Qualifying Segments shall apply concurrently, i.e. Qualifying Miles and Qualifying Segments shall apply, and not one or the other.

10.3.1.1. For example:

a) SILVER category: if the Participant accumulates 14,000 (fourteen thousand) Qualifying Miles and 14 (fourteen) Qualifying Segments, will receive the Upgrade and/or maintenance of the Silver Category, so that 10,000 (ten thousand) Qualifying Miles and 10 (ten) Qualifying Segments will be concurrently discounted and, for the subsequent calendar year (January to December), only 4,000 (four thousand) Qualifying Miles and 4 (four) Qualifying Segments will be valid in the participant's account.

b) GOLD category: If the Participant accumulates 21,000 (twenty-one thousand) Qualifying Miles and 24 (twenty-four) Qualifying Segments, he/she will receive the Gold Category Upgrade and/or maintenance, so that 18,000 (eighteen thousand) Qualifying Miles and 18 (eighteen) Qualifying Segments will be concurrently discounted and, for the subsequent calendar year (January to December), only 3,000 (three thousand) Qualifying Miles and 6 (six) Qualifying Segments will remain valid in the Participant's account.

c) Diamond category: If the Participant accumulates 32,000 (thirty-two thousand) Qualifying Miles and 34 (thirty-four) Qualifying Segments, he/she will receive the Upgrade and/or maintenance of the Diamond Category, so that 30,000 (thirty thousand) Qualifying Miles and 30 (thirty) Qualifying Segments simultaneously will be concurrently discounted and, for the subsequent calendar year (January to December), only 2,000 (two thousand) Qualifying Miles and 4 (four) Qualifying Segments will remain valid in the Participant's account.

11. FROM THE DEFINITION OF THE SMILES CATEGORY

11.1. The category of the Participant in the Smiles Program will be defined according to the number of Qualifying Miles accumulated or the amount of Qualifying Segments flown during the calendar year (January to December) with Gol or the Airline Partners, as shown in clause 10. above.

11.2. Smiles Cards in the SILVER, GOLD and Diamond categories will be valid from the date they are won until the end of the current calendar year and for an additional period of 15 (fifteen) months.

11.3. The Entrant who does not accumulate the number of Qualifying Miles required to stay in his current category or does not fly Qualifying Segments with Gol or Smiles Air Partners in the amount required to stay in the current category, within the previous calendar year (January to December), shall be reclassified into the immediately lower category, valid for 12 (twelve) months. This rule does not apply to the SMILES category, in which the Entrant will remain until promoted. The Smiles Participant who earns Qualifying Miles to maintain their current category in the said period will have their card extended for an additional period of 12 (twelve) months.

11.3.1 Qualifying Miles and Qualifying Earned Segments, recorded during the calendar year (January to December), will be valid until December 31 of this calendar year. From January 1 of the subsequent calendar year, a new cycle begins, zeroing the count of Qualifying Miles and counting of Qualifying Segments flown in the Participant's Smiles Account, except in the hypotheses set out in item 10.3 point: b, c and d.

11.4 GOL MAY, AT ANY TIME, MODIFY THE RULES RELATING TO THE CATEGORIES OF SMILES CATEGORY CARDS, INCLUDING UPON THE LAUNCH OF NEW CATEGORIES OR QUALIFYING SEGMENTS, REPLACING OR NOT THE CURRENT ONES, PREVIOUSLY COMMUNICATING THE CHANGE TO THE PARTICIPANTS OF THE SMILES PROGRAM, NOTING, WHEN APPLICABLE, THE TERMS OF ITEM 14.4..

12. REDEEMING SMILES AWARDS

RULE

12.1. The Participant may redeem (redeem) their Smiles Miles for Smiles Rewards, directly on the Smiles Site, using their Smiles Access Data, following the rules contained in these Regulations and the website itself.

12.1.1. All information necessary for the issuance of Air Tickets, such as required number of Smiles Miles, available national and international destinations, flight dates and times and seat availability, are available on the Smiles Program channels (Site Smiles, app, etc.) for online consultation by Participants when searching for the flight(s). The number of Smiles Miles required for the issuance of the Air Ticket may vary according to the Air Partner, the class and destination chosen by the Participant, in addition to the other factors specified in this Regulation.

12.1.2. The Participant declares that he/she is aware that Gol does not practice predetermined prices for Air Tickets or other Prizes. The prices charged will be those available and informed in the Channels of the Smiles Program, upon prior consultation, and consider, among other factors, the availability of the Prize offered by you or the Airline Partner, Commercial and/or Financial Partner; the conditions of supply; demand; availability of spot market seats and Smiles Miles; the prevailing price of spot market seats and miles; the advance of the purchase; periods of high demand, such as holidays and commemorative dates; as well as the cost of acquiring the Premium and macroeconomic conditions and indices.

12.1.3 Gol declares that it acts as an airline, but not as a manufacturer of products and/or retailers, not controlling the stock and quantity of Partners' Awards, including Air Tickets (except yours), products and/or services, and cannot guarantee the price conditions made available on the Smiles Site until the operation desired by the Participant is authorized, confirmed, and completed by its Partners.

AIR TICKETS

12.2. Redemption of Smiles Miles will preferably take place by issuing Air Tickets as a Smiles Award.

12.2.1. The redemption of Air Tickets is conditional on the existence of seats available for issue with Smiles Miles, in accordance with the availability rules defined by Gol and the Air Partners. The Smiles Program Participant should be aware that seats may be exhausted at the time he or she wishes to redeem the Air Ticket.

12.2.2. It is the sole responsibility of the Participant to be aware of the fare rules and the content of Gol's contract of carriage and intermediation – redemption of air tickets, which will be made available to him by Gol and the Air Partner at the time of the issuance of the Air Ticket. In case of doubt, the Participant may obtain information on the Smiles Site or contact the Smiles Service Center.

COMMERCIAL PARTNER PRODUCTS AND SERVICES

12.3. You will optionally be allowed to also use your Smiles Miles to redeem Commercial Partner products or services in the Online Store. The list of products or services offered, the number of Smiles Miles required for redemption, as well as the specific rules and conditions of operation of the Virtual Store can be found in the Smiles Program channels.

12.3.1. As this is a customer loyalty program whose main purpose is the renegotiation of Smiles Miles with the issuance of Air Tickets, the Network of Commercial Partners of the Smiles Program may change over time, and may be discontinued or included at any time, without prior notice. Gol is committed to keeping up to date the relationship of the Commercial Partners disclosed on the Smiles Website.

12.3.2. Gol reserves the right to terminate all partnerships that allow the redemption of Products and Services of Partners in the Virtual Store, provided that the standard form of redemption of Smiles Miles is maintained by redeeming Air Tickets.

12.4. The products or services offered in the Online Store are the sole responsibility of the Commercial Partners. Any information or clarification stemming from the products or services marketed in the Online Store must be obtained by the participant directly from the Commercial Partners. Any delays in the delivery of the product or service, defects, even if hidden, defects, exchanges, cancellations, or complaints must be dealt with directly with the Commercial Partners, as well as the exercise of the right of repentance provided for in the Consumer Protection Code.

12.4.1. Without prejudice to the provisions of item 12.4., Gol will make available, through its Call Center, a channel to meet the needs of the Participants.

12.5. Fees may be charged for redemption, issuance, cancellation, refund of Smiles Miles or withdrawal of Smiles Rewards, transfer of Smiles Miles, among others, as stipulated by Gol or partners, or other fees, always widely disclosed to Participants.

13. AIR TICKETING

13.1. To issue Air Tickets the Participant must be with his/her regular Smiles Account, as well as: i) access the relevant area on the Smiles Program website; ii) carefully read the information relating to each Air Ticket; iii) have the amount of Smiles Miles required for the issuance of Air Tickets; iv) tickets are available for issue at the time of the search; and v) have the payment of the other fees and amounts approved by your credit card company.

13.2. The issuance of Air Tickets is effective with the debit of the Smiles Miles of the Participant's Smiles Account, as well as with the payment of airport fees and other services charged by Gol and/or Air Partner, if applicable. It is the Participant's responsibility to verify that the issuance of his/her Air Ticket has been duly completed with the correct debit of the Miles on the Smiles Program Site, in his/her area, as well as the effective payment of fees and/or services via the credit card used and/or using Smiles Miles for settlement of such fees and/or services, where possible and where applicable.

13.2.1. Gol cannot be held responsible in the event of incorrect completion of the issue, without the Participant following the entire procedure until its effective completion, which is communicated via sending an e-mail registered by the Participant, as well as for the provision of adequate and correct information in the Participant's Smiles Account.

13.3. Air Tickets may be issued on behalf of the Participant or another person, within the limit determined by the time of redemption and at the limit determined by Gol presented in item 13.3.1 below. However, the responsibility for the movement of the Smiles Account is exclusive to the Participant, as is its sole responsibility for the undue provision of Smiles number and/or password to third parties, which is expressly forbidden by these Regulations and which is subject to the penalties presented in item 5.3., without prejudice to the penalties applicable to the Brazilian legal system.

13.3.1. The Participant may issue in his/her Smiles Account Air Tickets to himself and to 25 (twenty-five) different persons, regardless of the degree of kinship, affinity, and the like, in any respect, in the period of the calendar year (January to December). Each calendar year (January to December) a new count begins.

13.4. Air Tickets may be issued independently, i.e., the Participant may issue round-trip segments. Each country establishes rules for entry and exit in the country, therefore, it is the Responsibility of the Participant to observe the obligation to issue the Air Ticket back to the country of origin of the outbound flight.

13.5. AT THE TIME OF ISSUING THE AIR TICKET, THE PARTICIPANT MUST CAREFULLY OBSERVE ALL THE CRITERIA AND DATA FOR THE CORRECT ISSUANCE, SUCH AS PERSONAL INFORMATION, NAME, CPF, AMONG OTHERS.

THE AIR TICKET ISSUED WITH GOL CAN ONLY BE CHANGED WHEN THERE ARE OPERATIONAL OR SYSTEMIC INCONSISTENCIES OR, STILL, WHEN PERMITTED BY LAW, OBSERVING THE LIMITS SET FORTH IN THIS.

THE AIR TICKET ISSUED WITH THE AIRLINE PARTNERS MAY NOT BE CHANGED IN ANY RESPECT BY THE GOAL, EXCEPT WHEN AUTHORIZED BY THE AIRLINE PARTNER AND/OR WHEN THE FINDING OF OPERATIONAL OR SYSTEMIC INCONSISTENCIES.

13.6. The Gol Air Ticket may be cancelled by the Gol Air Ticket, in line with the cancellation rule applicable to each type of fare. The Air Ticket of the Air Partners may be cancelled by Gol, provided that authorized by the Air Partner and provided for in the tariff rules and in the content of the intermediation contract - redemption of air tickets. Once cancelled, valid Smiles Miles will be refunded upon payment of the applicable fees, and the Participant may reissue at his/her discretion. Smiles Miles refunded as a result of cancellation will have their validity period maintained in accordance with the period that was in force when the Ticket was issued cancelled. Refunded Smiles, the expiration date of which has expired, will not be refunded.

14. FINAL PROVISIONS

14.1. The Participant expressly acknowledges Gol's exclusive ownership of the Smiles brand and other related brands, products and services. The agreement to the Smiles Program does not presume, much less entails any form of license or authorization for the Participant to make use, free or remunerated, of Gol's trademarks. Any and all use of Smiles trademarks will always revert to Gol's sole benefit.

14.2. The Participant acknowledges Gol's right, at any time and by unilateral act, to add, modify or update the rules, terms and conditions of these Regulations. Any addition, modification or update will be communicated in advance to Participants, through the Smiles Site and by e-mail. If the Participant continues to use the Smiles Program after notice of addition, modification or update of these Regulations, this will characterize the acceptance of the implemented changes.

14.3. The Smiles Program Regulations, as well as any additions, modifications, or updates, is public and is registered with the Registration Officer of Titles and Documents of the city of Barueri, State of São Paulo, under no. 1.104.392, and registered under No. 1763287, in session of September 10, 2021. Such documents are also available on the www.smiles.com.br.

14.3.1. This instrument will become effective from 14 September 2021 for an indefinite period, cancelling and replacing the contracts and their previous registrations.

14.4. The Smiles Program may, at any time and by unilateral act of Gol, be suspended, terminated or modified, or have its management transferred, upon prior communication to participants, at least 90 (ninety) days in advance, through the Smiles Site and by e-mail. In any event, the Participant's right in respect of the Smiles Miles accumulated by him or her until the date of suspension, extinction or modification shall be protected.

14.5. Cases omitted in these Regulations will be dealt with directly between the Participant and the administration of the Smiles Program. Any tolerance of non-compliance or omission in the execution of its rights by Gol will not constitute a waiver, ineffectiveness or re-application of the rights and obligations agreed herein, nor will it prevent Gol, even if extemporaneously, from requiring the fulfillment of such rights and obligations.

14.6. Any exceptions to the rules, terms and conditions of these Regulations shall apply only if they appear in a written document signed by Gol's legal representatives.

14.7. Gol shall not be considered in default or default in relation to any right or obligation provided for in these Regulations if the reason for non-compliance arises from a fortuitous case or force major, in the manner established by the Brazilian Civil Code, Law No. 10,406, of January 10, 2002.

14.8. All rules, terms, conditions set forth in these Regulations are independent. Thus, in the event that any of its rules, terms or conditions is considered, for any reason, by competent judgment or arbitrator, invalid, unenforceable, or illegal, in whole or in part, the validity and enforceability of the other rules, terms and conditions, or parts thereof, shall not be affected.

14.9. Gol provides the Customer Service by various means, as provided in these Regulations.

14.10. This Regulation shall be governed by, interpreted, and executed in accordance with the laws of the Federative Republic of Brazil, regardless of conflicts of laws with the laws of other states or countries, and the Forum of the place that the Participant deems most pertinent, in Brazil, is competent to resolve any doubt arising from this instrument. The Participant expressly consents to the jurisdiction of this judgment, and renounces, in this act, the competence of any other forum, however privileged it may be or will be.
