6. Awards
6.1 These terms and conditions cover both general and specific rules of the Program for each award. The specific rules and tables for each award are part of the annexes to these regulations and will be replaced upon amendment and/or cancellation of respective award.
6.2 The awards comprise Smiles tickets, Smiles Any Day tickets, Upgrades Smiles, Smiles Promotional tickets and Smiles Airline Partner tickets.
6.3 Smiles reserves the right to suspend issuance of any award, if any irregularity committed by the participant is identified and can deny authorization of the issuance of any award in question.
6.4 To redeem Smiles awards, members should follow the instructions as provided in item 6.4.1.
6.4.1 Redemption of the Smiles tickets or Upgrades Smiles may be requested through the Smiles Customer Service Center , at the Smiles (www.smiles.com.br) or in person at the VRG Linhas Aéreas stores, identified through the brands GOL or VARIG and must abide by the security regulations described in item 2.3 of these regulations. Miles, for each award, will be redeemed from one single Smiles account, according to the Smiles Awards Schedule (Attachments I, II and III) prevailing on the date of issuance. In case of amendment to the Smiles account, reservation will be cancelled and the award issue will be suspended. When the Smiles award is in the name of the participant him/herself, it may be requested from the representative upon presentation of the appropriate documentation at a VRG Linhas Aéreas store, identified through the brands GOL or VARIG Information regarding the required documents is available at the Smiles Call Center and at VRG Linhas Aéreas stores, identified through the brands GOL and VARIG Smiles Customer Service Center contacts in Brazil and abroad are available at the Smiles site.
6.5 The Smiles Program reserve the right to determine which flights are eligible for the use of awards. In order for an award to be issued a reservation must be confirmed for the entire itinerary in the specific class reserved for Smiles.
6.6 Smiles Awards
6.6.1 Smiles awards are non-transferable and cannot be endorsed and must be issued in the name of the participant or in the name of third parties that the participant has indicated by no later than 3 (three) hours prior to the flight. Tickets will be issued in exchange for accrued mileage in the Smiles Program as per theses terms and conditions. Miles must be valid at the time of ticket issuance.
6.6.2.1 Smiles Ticket Table: are tickets having one way routes only, i.e., outgoing or incoming on VRG Linhas Aéreas flights operated by the brands GOL or VARIG, originating or having a destination within South America (ANNEX II); ;
6.6.2.2 Air Partner Smiles Tickets: those are round trip tickets issued for Smiles Program air partners (ANNEX III); Attachment II has been temporarily suspended and will be effective as soon as the specific agreement of VRG Linhas Aéreas has been signed with a partner airline.
6.6.2.3 Any Day Smiles Tickets: is a one way ticket only either to or from a destination on VRG Linhas Aéreas flights operated by the brands, with origin or destination in South America that require a higher value in miles since they have the same reservation priority as a ticket that has been paid at the full rate. This award is available only on VRG Linhas Aéreas flights operated by GOL or VARIG (ANNEX II);
6.6.2.4 Smiles Promotional Tickets are promotional tickets subject to special terms for routes operated by GOL and VARIG as well as the value in miles and the validity determined by the Smiles Program.
6.6.3 Award Tables: Award Tables show different terms and remarks. Those tables are available at the site ( www.smiles.com.br ) or through the Smiles Service Centers. Award Tables are incorporated as annexes hereto and are so filed with the Sixth Registrar of Documents in the city of São Paulo .
6.6.3.1 Award Table refering to the brands GOL and VARIG – used in connection with the issuance of the following award: Smiles Upgrades (ANNEX I);
6.6.3.2 Award Table refering to the brands GOL and VARIG – used in connection with the issuance of the following awards: Smiles Tickets and Any Day Smiles Tickets (ANNEX II);
6.6.3.3 Partner Air Ticket Schedule – schedule available for issuance of Smiles Partner Awards (Attachment III). Attachment III has been temporarily suspended and will be effective as soon as the specific agreement of VRG Linhas Aéreas has been signed with a partner airline.
6.6.4 Smiles members traveling on Award Tickets are responsible for the payment of all airport charges and specific governments of each country on the itinerary of your award Terms of payment for such charges will be defined in accordance with VRG Linhas Aéreas acceptance policy in force on the date the award is issued.
6.6.5 All Smiles Awards are valid for one (1) year as from the issuance date and are not extendable or reimbursement request for expired miles that comprise the award. The validity of Promotional Smiles Awards is defined at all times on the basis of the terms and regulations of the promotion.
6.6.6 Changes in the date and route (re-booking) are permitted within the validity of the ticket, upon payment of the administrative fees (see item 7) and regulations set forth in Attachments I, II and III (see 6.6.3) of these Regulations. The participant must request the change from the Smiles Customer Service center or VRG Linhas Aéreas store refering to the brands GOL or VARIG by no later than 3 (three) hours prior to travel and the reservation for the new date, flight or route must be confirmed. Changes in boarding times cannot be made if the reservation has not been confirmed in a specific Smiles class.
6.6.7 Reimbursement is permitted only for unused Smiles awards within their validity terms (see item 6.6.5), based on the payment of the administrative fee (see item 7) and in compliance with the regulations prevailing in Attachments I, II and III (see 6.6.3) of these regulations.
6.6.8 Smiles reservations and awards can only be made directly with VRG Linhas Aéreas through the Smiles Customer Service Center , GOL or VARIG agencies and the Smiles site. For that purpose, members will have to inform their Smiles numbers and their accounts should have enough mileage for the issuance in question. No reservations or issuance made through any other agents are acceptable for this kind of tickets.
6.6.9 When booking for any kind of Award Tickets, members will have to inform the office assistant that it is an Award Ticket. O therwise the reservation will be cancelled. Bookings for Award Tickets are still subject to an issuance period to be informed on the occasion of reservation.
6.6.10 Reservations are subject to seat availability. When making reservation of an Award Ticket, members may note that, although the flight is not fully booked, the award may not be available. VRG Linhas Aéreas and their partners reserve the right to limit the number of seats available to award tickets.
6.6.11 When a participant is traveling under the benefit of some type of Smiles Award and is accompanied by a child under 2 (two) years of ages (Infant), the child will be boarded with a lap seat status, since, according to the VRG Linhas Aéreas policy, there is no rate for this age group.
6.6.12. When a Smiles participant is traveling on some type of Smiles Award, in the company of a child 2 (two) to 12 (twelve) incomplete years of age:
- a ticket can be issued at the available rate according to the VRG Linhas Aéreas current rate policy for children 2 to 12 incomplete years of age in the same service class as that of the person responsible, or
- to issue a Smile Award for the child with same number of miles used for an adult at such class as the accompanying adult is traveling;
6.6.13 Smiles Upgrades
6.6.13.1 Upgrades Smiles is a one way ticket only either to or from a destination, on VRG Linhas Aéreas S/A flights operated by operated by the brands GOL or VARIG, - (Anexo I) with origin or destination within South America (ANNEX I), to another, in the Comfort service class. -. Claiming of Upgrade Smiles can be requested and obtained by contacting the Smiles Customer Service Centers or the stores identified with the brands GOL or VARIG agencies.
6.6.13.2 To issue an Upgrade Smiles-, the participant shall request a reservation directly in the Upgrade Smiles class (in the Comfort service class section) and once the reservation is confirmed, the participant shall pay the promotional discounted rate in the economic service class, as well as claim the appropriate number of miles according to the Upgrade Smiles Schedule - (ANNEX I).
6.6.13.3 The Smiles participant traveling in the company of a child under 2 (two) years of age ( Infant ), willing to travel using an Upgrade Smiles, shall be boarded with the child having a lap seat status, since, according to the VRG Linhas Aéreas policy, there is no applicable rate for this age group.
6.6.13.4 The Smiles participant who is in the company of a child under 12 (twelve) years of age (child) who would like to travel using an Upgrade Smiles One Way, can:
- Issue a ticket at the available rate according to the VRG Linhas Aéreas current rate policy for children 2 to 12 incomplete years of age in the same service class as that of the person responsible, or
- Issue an Upgrade Smiles at the same rate and miles as used by any adult.
