TERMS AND CONDITIONS OF THE SMILES PROGRAM

1. General Conditions

 

1.1. Each Smiles member is responsible for knowing all the terms and conditions of the Program and corresponding annexes, which are all filed with the Sixth Registrar of Documents in the city of São Paulo , under No. 1436728

 

1.2. Membership is opened to all individuals, without age limitation. Responsibility for accounts in the name of minors will fall on respective legal representatives according to the legislation criteria of each country.

 

1.3. Membership in the Smiles Program is free and interested persons can register for the program at the Smiles site: www.smiles.com.br and at the Smiles Customer Service Center . The participant will receive an identification number at the time of enrollment in the Smiles Program.

 

1.4. As soon as participants use their number to accumulate Smiles miles, when purchasing products and services from VRG Linhas Aéreas S.A (“VRG Linhas Aéreas”), identified through its brands GOL or VARIG and the other airlines and non airline companies which have partnership agreements with the Smiles Program (“Partners”), they will be confirmed as having joined the Smiles Program as well as having accepted all the terms of these Regulations and their annexes.

 

1.5. Smiles miles will only be credited toward the name of the participant in the Smiles Program after having duly enrolled in this Program.

 

1.6. Miles accumulated from flights operated by VRG Linhas Aéreas, identified by the brand GOL – Linhas Aéreas Inteligentes, are valid beginning October 16, 2008. Only flights made as from this date are eligible for miles credit in the Smiles account.

 

1.7. The Smiles card is personal and not transferable, and remains the property of the Smiles Program, and should be surrendered if so is requested. Members should always present it when requested to do so by VRG Linhas Aéreas, whether it is in a flight identified as the brands GOL or VARIG or any other Program partner companies.

 

1.8 . Miles accumulated in the participant's Smiles Program account can be redeemed for air tickets on VRG Linhas Aéreas flights operated by the brands VARIG or GOL and the other airline partners in the Smiles Program.

 

1.9 Redemption of Smiles miles in VRG Linhas Aéreas air tickets operated by the brand GOL will be effective beginning November 16, 2008.

 

1.10 Credits to the Smiles account, Smiles awards, Smiles cards, Smiles miles are deemed property of the Smiles Program, and they may only be used in accordance with the conditions established herein.

 

1.11. In case of death of a member, respective Smiles account will be closed and accumulated miles canceled. The undue use of deceased member miles will subject the violator to proper legal remedies.

 

1.12 At no time may any Smiles Program mileage credits or award tickets be commercialized in any way and violators may be liable to appropriate judicial remedies.

 

1.13 If a member fails to comply with these terms and conditions, the Smiles Program reserves the right to suspend or cancel the account temporarily or definitively, as well as to refuse the violator the use of awards and benefits offered by the Smiles Program. Any Smiles awards issued as a result of mile credits that are not in accordance with these terms and conditions must be reimbursed by the member.

 

1.14. The Smiles Program reserves the right to make available special offers and benefits for a limited period of time, and to cancel and/or change them at any time without prior notice.

 

1.15. VRG Linhas Aéreas reserve the right to suspend or cancel the Smiles Program at any time, or to amend its terms and conditions without prior notice. Members may cancel their membership in the Smiles Program at any time upon express notice and return of their Smiles cards.

 

1.16 If, for any legal reason or prohibition arising from governmental regulation in any country in which VRG Linhas Aéreas and their Partners operate and the Smiles Program Regulations or benefits cannot be fully upheld, VRG Linhas Aéreas shall not be held liable by the participants and the Partners.

 

1.17. The Smiles Program is not liable in any way for the services provided or products offered by the Partners, and it is the responsibility of the participant to enter into agreement with any of the referenced Partners.

 

1.18. Any omission or items that are not provided for in these Regulations will be handled directly between the participant and the Smiles Program management.
