Smiles Program Regulation is in force since Feb/07/2007 (including) as product of VRG Linhas Aéreas, replacing and cancelling the previous one.

1. General Conditions

1.1 Each Smiles member is responsible for knowing all the terms and conditions of the Program and corresponding annexes, which are all filed with the Sixth Registrar of Documents in the city of São Paulo.

1.2 Upon using his/her Smiles card to accrue miles on VRG Linhas Aéreas and any Smiles Program partner companies, whether air or non-air partners, each member automatically agrees to all the terms and conditions of the Program and respective annexes.

1.3 Membership is opened to all individuals, without age limitation. Responsibility for accounts in the name of minors will fall on respective legal representatives according to the legislation criteria of each country.

1.4 Flights, purchase of products or use of Smiles partners’ services prior to enrollment date are not eligible for mileage credit.

1.5 Each member is allowed only one account. In case of duplicity, one of the accounts will be canceled and respective balance will be transferred to the continuing active account. Any enrollment or promotional bonuses will be credited once only.

1.6 The Smiles account PIN code is personal, and each member takes full responsibility for its use. For security reasons, we suggest that it be kept in a safe place, and should not be revealed to anyone else.

1.7 Members should advise the Smiles Call Center on any change in their profile (change of address, telephone, etc.) and are responsible for the given information. Whenever necessary, the Smiles Program will request documents supporting the change to members’’ details. Smiles will not take responsibility for loss or delay of correspondence.

1.8 The Smiles card is personal and not transferable, and remains the property of the Smiles Program, and should be surrendered if so requested by the Smiles Program. Members should always present it when requested to do so by VRG Linhas Aéreas or any other Program partner companies.

1.9 Credits to the Smiles account, Smiles awards, Smiles cards, Smiles miles are deemed property of the Smiles Program, and they may only be used in accordance with the conditions established herein.

1.10 In case of death of a member, respective Smiles account will be closed and accumulated miles canceled. The undue use of deceased member miles will subject the violator to proper legal remedies.

1.11 At no time may any Smiles Program mileage credits or award tickets be commercialized in any way and violators may be liable to appropriate judicial remedies.

1.12 If a member fails to comply with these terms and conditions, the Smiles Program reserves the right to suspend or cancel the account temporarily or definitively, as well as to refuse the violator the use of awards and benefits offered by the Smiles Program. Any Smiles awards issued as a result of mile credits that are not in accordance with these terms and conditions must be reimbursed by the member.

1.13 The Smiles Program reserves the right to make available special offers and benefits for a limited period of time, and to cancel and/or change them at any time without notice.

1.14 VARIG reserve the right to suspend or cancel the Smiles Program at any time, or to amend its terms and conditions without notice. Members may cancel their membership in the Smiles Program at any time upon express notice and return of their Smiles cards.

1.15 If any provision of these terms and conditions or Smiles Program benefits may not be complied with in full in view of any judicial matter or prohibition deriving from governmental regulations of any one country where VRG Linhas Aéreas and their partners operate, VRG Linhas Aéreas will be discharged of any responsibility whatever with respect to members and partner companies.

1.16 The Smiles Program is not responsible for the products or services provided by the participating companies. Members should deal directly with each one partner company in case any problem arises.

1.17 Anything omitted or not provided for by these terms and conditions will be handled directly between the member and the Smiles Program administration.
